General Agreement

These Terms of Use (the "Terms") govern your access to and use of the "Event Poll App" software product developed as a Software-as-a-Service (the "Service"). By using the Service, you agree to be bound by these Terms. If you disagree with these Terms, you are not authorized to access or use the Service.

The owner of the Service reserves the right to change these Terms at any time. The changes will be published on the Service website www.eventpoll.app and the Effective Date will be updated at the top of these Terms. Your continued use of the Service after the changes have been agreed to constitute your agreement to the changes.

License

The Service is provided as a direct customer service only personal to you is nontransferable and is not for resale. You may use the software for your own personal and internal use only. You may not modify, adapt, or create derivative works of the software. You may not redistribute the software without the express written permission of the Service’s owners.

Age Restriction

The service is intended for users who are 17 years of age or older. By using the software, you represent and warrant that you are at least 17 years of age. If you are not at least 17 years of age, you must have the permission of your parent or guardian to use the software.

Intellectual Property and Copyrights

All copyrights and copyrightable materials that are a part of the Service, including but not limited to the logos, designs, text, graphics, pictures, photos, files, software, applications, code, hidden text, databases, and other files and the selection and arrangement thereof are copyrighted by the Service owners and are protected by United States and international copyright laws. All rights are reserved.

Purposes and Acceptable Uses

The Service offers an exceptional platform for engaging individuals and receiving real-time audience feedback. Users can actively participate in live polls and surveys, making it an excellent means to involve people in the event.

The Service focuses on various purposes, such as:

• Gathering feedback to enhance the effectiveness of events.
• Ensuring companies meet the needs of their employees.
• Engaging participants in presentations, meetings, and meetups.
• Ensuring students comprehend the material and are prepared for assessments.

The Service is a valuable tool designed to enhance communication, engagement, and learning.

Violations and Prohibited Uses

Users of the Service are solely responsible for all content that they create, post, or share on the Service.

The Service may only be used for lawful purposes. The Service may NOT be used for any of the following prohibited activities:

• Harassment
• Spam
• Copyright infringement
• Defamation
• Illegal activities

Additionally, you agree NOT to use the Service for any of the following purposes or activities, including, but not limited to:

• Creating, resending, or posting any message, data, information, text, software, graphics, files, materials, or other Content that is unlawful, hateful, violent, or discriminatory.
• Getting unauthorized access to the Service, denial-of-service attacks, hacking, and other forms of malicious activity.
• Using and uploading any material that contains malware, spyware, and other forms of malicious software or any other harmful, destructive, or deleterious programs.
• Sending unsolicited commercial or promotional messages.
• Creating fake accounts or using someone else's identity without their permission.
• Distributing or helping to distribute child pornography or engaging in other forms of child exploitation.
• Uploading copyrighted material without the permission of the copyright holder.
• Collecting or sharing personal information about others without their consent.
• Violating laws governing fraud, theft, and drug trafficking.
• Following or harassing another person without their consent.
• Scraping or crawling the Service's website, using any bots or other automatic devices, as well as copying the Service's content without prior express written permission
• Posting a link, address, or other contacts to websites or any locations that contain prohibited content.
• Creating, duplicating, or transmitting any pornography.

Dual-Role Accessibility

The Service has a distinctive dual-role accessibility:

• Creators
• Participants

Creators, who create events and polls, are required to have an account to unlock the full suite of tools for content management. In contrast, Participants enjoy a flexible approach, allowing them to join events without the need for account creation. This inclusive dual-role system ensures that both Creators and Participants can engage with the app in a manner that aligns with their preferences.

Account Registration

By creating an account, Creators gain access to essential tools, empowering them to handle events efficiently. This registration process is designed to enhance the overall functionality and convenience of event management within the Service.

Account Deletion

All users can delete or clean up their accounts at any time. This can be easily done through:

• In-App "Profile" section: Profile settings within the application, where users find options to delete or clean up their account.
• App Store Page: Alternatively, if the store allows the option, users can manage their account deletion directly through the application's associated page on the store.
• Contacting Support: If users prefer personalized assistance or have specific queries, they can contact our support team at support@eventpoll.app. Our support team will address queries within 24 hours.

To cancel a user's subscription after deleting the account, the user must handle it separately in their device's account settings.

Data Collecting

During your interaction with the Service, we may collect certain data to provide the necessary functionality, enhance your experience, and improve the Service. This data may include, but is not limited to, user preferences, device information, and user-generated content. The collection of data is conducted with the utmost respect for your privacy and following our Privacy Policy.

Content Moderation

As part of our dedication to transparency and user privacy, the Service employs content moderation practices. To understand our moderation process, including the handling of user-generated content and its implications on privacy, please refer to our Privacy Policy.

Any content violations of the Terms of Use may result in access restrictions, account blocking, reviewing, and removing such content from the Service by our moderation team. We take these measures to provide a secure space for all users.

We commit to evaluating any reported content and taking appropriate action within 24 hours.

Liability Disclaimer

The Service shall not be liable for any of the following, including but not limited to:

• Damages: indirect, special, incidental, punitive, exemplary, or consequential damages (including damages that arise from loss of anticipated revenue, loss of information or material of any kind, lost profits, loss of business, or injury to person or property, even if the Service has been advised of the possibility of such damages).
• Your reliance on any materials, content, information, links to the websites, software, or products obtained in the Service.
• Mistakes, omissions, interruptions, communications failure, deletion of files or e-mail, errors, defects, delays in operation or transmission, or any failure of performance.
• Theft, destruction, or unauthorized access to your records.
• Resolving conflicts and misunderstandings between poll creators and participants.
• The unavailability of the Service is due to circumstances beyond our control.

Termination

This Agreement may be terminated by either party at any time, for any reason, with or without notice.

Upon termination of this Agreement, all rights and obligations of the parties hereunder shall immediately terminate, except for any rights or obligations that by their nature survive termination.

The Service owner has the right to terminate this Agreement and terminate your access to the software for the following reasons, but is not limited to these reasons:

• Violation of any provision of this Agreement.
• Use of the software for any illegal or unauthorized purpose.
• Intentional or reckless damage to the software or the systems that host it.
• Repeated violations of the terms of service.

Payments Policy

Free for Participants:

Users participating as guests or voters (event participants) always have free access to the Service.

Freemium Model for Creators:

The Service operates on a freemium model, offers basic features of service to users at no cost (Basic plan), and charges a premium for limitless and advanced features(Premium plan). The current plan name is displayed on the "Profile" setting screen within the app.

Basic Plan:

The plan is Free and includes essential features with certain limits (refer to the pricing section on the Service's website):

• Unlimited scheduled events.
• Unlimited poll sets.
• Single-choice polls.
• Multi-choice polls.
• Instant creator's messages.
• Maximum launching one event at a time.
• Maximum 25 online participants at a time.
• Maximum 100 responses per poll.

Premium Plan:

The subscription-based plan is available on a monthly, semi-annual, or annual billing cycle. This plan enhances the basic features, eliminates limits, and incorporates additional functionalities (please refer to the pricing section on the app website):

• Parallel Events Launching.
• Unlimited Online Participants.
• Unlimited Responses per Poll.
• Polling Engagement Analytics.
• Instant Participants Messages.
• Export Poll & Sensor Data.
• Open-End Polls.
• Poll Pictures.

Subscribers can easily manage and cancel their Premium subscription at any time.

All payments are processed through a secure payment processor by the store. All personal information is encrypted and protected by the payment provider.

Subscription Canceling

You have the right to terminate enabled subscriptions at any time.

If you subscribed to our Premium plan, the process for canceling your subscription may vary based on the platform. Follow next guidelines to cancel your subscription:

Notices

The owners of the Service may contact you via electronic mail at the email address you provided during the registration process. Notices may encompass information regarding updates, modifications to the Service, as well as changes to the terms of service and privacy policy.

If you find yourself in disagreement with the proposed changes, you have the option to terminate your account. This can be done by reaching out to the Service support at support@eventpoll.app or by utilizing the account deletion feature directly within the Service.

Governing Law

This Terms of Use Agreement shall be governed by and construed under the laws of the United States of America, without regard to its conflict of law provisions.
